Definitions:
Organiser: Can Too Foundation Limited (ABN 53 169 310 696).
Sponsor: Any entity providing financial or in-kind support to the Organiser.
Released Persons: The Organiser, its Sponsors, related entities, staff, Board members, volunteers, contractors, and affiliates.
By registering for and participating in CanToo’s Cold Plunge for Cancer, you acknowledge and accept that:
- Participation in cold water activities, including ocean swims, pool swims, cold plunges and ice baths, involves inherent risks including but not limited to cold exposure, personal injury, illness (including infectious disease), accidents, adverse weather, wildlife interactions, drowning and the conduct of other participants or third parties.
- You voluntarily accept full responsibility for assessing and managing the risks associated with your participation.
- You will only participate in conditions and locations you consider safe and appropriate for your ability
- You understand CanToo is not supervising participants or any activities
- You warrant that you are in appropriate physical and mental condition to participate safely and have undertaken suitable preparation.
- You agree to withdraw from the CanToo Cold Plunge for Cancer should you become unfit or medically unable to participate.
- You release and discharge the Released Persons from any liability (including negligence, breach of contract or statutory duty) for any loss, damage, illness, injury, or death arising from your participation in the CanToo Cold Plunge for Cancer, to the fullest extent permitted by law.
- You consent to the use of media captured during Cold Plunge activities to be used for promotional purposes by CanToo or Sponsors without compensation. You have the right to withdraw your consent at any time by getting in touch directly with Can Too Foundation.
