Can Too Foundation Program Terms and Conditions 
CONDITIONS OF ENTRY FOR ALL CAN TOO FOUNDATION PROGRAMS 

Definitions
Organiser: Can Too Foundation Limited (ABN 53 169 310 696). 
Sponsor: Any entity providing financial or in-kind support to the Organiser. 
Event(s): Third-party-organised activities participants train for through Can Too programs. 
Program: A structured training initiative delivered by the Organiser to prepare participants for Events.
Released Persons: The Organiser, its Sponsors, related entities, staff, directors, volunteers, contractors, and affiliates. 


Assumption of Risk and Waiver
 
By registering for and participating in a CanToo Program, you acknowledge and accept that:
  • Participation involves inherent risks, including but not limited to personal injury, illness (including infectious diseases), accidents, adverse weather, wildlife interactions, vehicle travel, and the conduct of other participants or third parties.
  • You voluntarily accept full responsibility for assessing and managing the risks associated with your participation.
  • You warrant that you are in appropriate physical and mental condition to participate safely and have undertaken suitable training and preparation.
  • You agree to withdraw from the Program should you become unfit or medically unable to continue.
  • You release and discharge the Released Persons from any liability (including negligence, breach of contract or statutory duty) for any loss, damage, illness, injury, or death arising from your participation in the Program, to the fullest extent permitted by law.

Indemnity

  • You agree to indemnify and hold harmless the Released Persons from any claims, actions, costs, or liabilities (including legal fees) resulting from your participation in the Program, including injury to yourself or others, or damage to property, except to the extent caused by the gross negligence or willful misconduct of the Organiser.


Medical Treatment & Insurance

  • You authorise the Organiser and Event medical personnel to provide or arrange medical assistance as deemed necessary during your participation.
  • You understand that any costs incurred (e.g. ambulance, treatment) will be your responsibility and not covered by Can Too Foundation insurance. 

Participation Requirements
  • You are at least 18 years of age.
  • You are physically fit and able to complete the required training and have sought medical advice if necessary.
  • You will comply with all Program instructions, including those from Coaches, Mentors, and Team Captains.
  • You will follow all Health & Safety guidelines and site-specific procedures.

Fundraising Commitment

  • You agree to raise the minimum fundraising pledge set at the time of Program registration.
  • If your fundraising falls short by 30 days after the Event, you agree to contribute the remaining amount personally. An invoice may be issued for the outstanding balance.
  • CanToo may close your fundraising page 30 days after the Program Event. 

Fundraising Commitment and Participation Eligibility
  • Participation in CanToo programs is subject to both a program fee and a minimum fundraising commitment, as outlined for each program. The funds raised by participants are essential to the ongoing delivery of CanToo programs and to fulfilling our mission of supporting cancer research and prevention.
  • Fundraising is not optional and is considered a core component of the CanToo program experience. While we recognise that fundraising outcomes may vary, all participants are expected to make a genuine and sustained effort toward their fundraising target.
  • Participants who repeatedly register for programs without demonstrating meaningful fundraising efforts may, at CanToo’s discretion, be deemed ineligible for future programs. This includes, but is not limited to, individuals who participate in multiple programs without meeting the minimum fundraising requirement or without engaging in fundraising activity.
  • Can Too Foundation reserves the right to refuse entry to, or withdraw a participant from, any current or future program if these expectations are not met. This is to ensure fairness to other participants and the sustainability of our fundraising model. 

Photography & Promotion
 
  • You consent to the use of your name, image, voice, or likeness in any broadcast, photograph, video, or promotional material by the Organiser or Sponsors without compensation.
  • You have the right to withdraw your consent at any time by getting in touch directly with Can Too Foundation. 

Program Changes & Cancellations
 
  • CanToo reserves the right to cancel, modify, or reschedule Programs or Events at its discretion.
  • Your entry may be rejected or cancelled at any time, including after acceptance and payment.
  • Refunds will be managed in accordance with our Refund Policy at www.cantoo.org.au/policies. 

Withdrawal Policy
  • If you withdraw due to medical reasons, you must provide a certificate from a qualified health professional.
  • You may still be expected to fulfil your fundraising commitment even if you withdraw from the Program.
  • Refunds or deferrals will only be considered in line with our Withdrawal and Refund Policies.

  • The content on the site such as such as text, graphics, images, photographs, illustrations, trademarks, trade names, service marks, logos and other materials ("Contents") is protected by copyright unless otherwise stated on this Site. Except as stated herein, the Content may not be used except as permitted in these Terms and Conditions or as stated in the text on the site.
  • The Contents must not be copied, reproduced, distributed, transmitted, republished, downloaded, displayed, modified, reused, or transmitted in any form or by any means without the written permission of Can Too Foundation Limited, ABN 53169310696 or its licensors.

Can Too Foundation Limited Security Policy

Can Too Foundation Limited uses PayPal and Stripe for its online credit card transactions.All online credit card transactions performed on this site using Stripe are secured payments. 

  • Payments are fully automated with an immediate response.
  • Your complete credit card number cannot be viewed by Can Too Foundation Limited or any outside party. 
  • All transactions are performed under 128 Bit SSL Certificate. 
  • All transaction data is encrypted for storage within Stripes bank-grade data centre, further protecting your credit card data. 
  • Stripe is an authorised third party processor for all the major Australian banks. 
  • Stripe at no time touches your funds; all monies are directly transferred from your credit card to the merchant account held by Can Too Foundation Limited.

Acceptance

By registering for a CanToo Program, you confirm that you have read, understood, and agreed to these Terms and Conditions. You acknowledge that this agreement is legally binding and will remain in effect indefinitely.
